PROBATE:

Under the Indian Succession Act, 1925 a PROBATE is defined as “A copy of the WILL certified under the seal of the Court of competent jurisdiction with a grant of administration of the estate of the Testator. A person who makes a WILL is called the Testator. rights pertaining to Through Probate, rights pertaining to the Administration of an estate is granted to the Applicant It is a Judicial pronouncement through which the validity and authenticity of a WILL are determined in the court of law.

SUCCESSION CERTIFICATE:

A Succession certificate under the Indian Succession Act, 1925 is a document that gives authority to the person who obtains it. to represent the deceased for the purpose of collecting debts and securities due to him or payable in his name. A Succession Certificate is issued in the absence of a Will. A Succession Certificate is a primary document through which the legal heirs can stake a claim to the assets of a deceased relative. It gives legal recognition to the rights of legal heirs to inherit the estate of the deceased.

WILL:

A WILL is a legal document that specifies a person’s intention and wishes, which needs to be performed after his/her death. The person who makes a WILL is called the Testator/Testatrix. A WILL can be revoked only during his/her lifetime.

CIVIL LITIGATION :

It is a term that applies to any legal disputes, between two or more parties, seeking monetary damages as well as specific performance. A legal way of resolving a dispute between the parties through the Court proceedings.

LETTER OF ADMINISTRATION:

If a person dies intestate, then the Applicant seeking Administrative rights pertaining to the deceased estate files or a Letter of Administration. Letter of administration is granted to the beneficiaries after they apply to a court of law having competent jurisdiction.

ESTATES:

Estate is all the property a person accumulates during his lifetime. Estate may include his Financial assets, stocks, Bank accounts, bonds, business. immovable properties and tangible assets such as paintings. The creator of these properties enjoys its benefits through out his life. But what happens to these assets on your sudden demise. That is where Estate planning comes in play. Estate planning is simply refers to passing down of your assets from one generation to another.

TRUST:

A trust is essentially created by a WILL. Hence it should comply with the laws of the land both pertaining to Trust and a Will. A testator may by WILL bequeath all or some of the properties for the benefit of one or more persons. The purpose should be clearly expressed in a WILL ex. maintenance of a family, or meeting the educational expenses of a child.
